Do I need to live in Wyoming or in the US?+
No. People living outside the US or in any US state can open a Wyoming LLC. The state requires a registered agent with a physical address in Wyoming, included for the first year.
How much does it cost per year to keep the LLC?+
The state annual report has a minimum fee of US$ 60 (license tax), due by the first day of the company's anniversary month; it can be higher depending on the company's assets in Wyoming. If the report is not filed, the state may dissolve the LLC.
Does a foreign-owned LLC have IRS obligations?+
It may: Form 5472 may be required depending on foreign ownership (25%+), reportable transactions and exceptions; check with your accountant. The penalty for not filing is high. An accountant, hired separately, can handle it; it is not included in the formation.
What is not included?+
Not included: domain, e-mail, phone or website; bank account; accounting and IRS filings; state annual fees and registered agent from the second year.
How long does it take?+
It depends on the state and the IRS, and no timeline is guaranteed. The filing goes to the state after the order is accepted by the filing partner. Without an SSN, the EIN is requested from the IRS by fax or mail: the IRS indicates about 4 business days by fax and about 4 weeks by mail.
Do I need an SSN?+
Not to open the company. The company's EIN can be obtained without an SSN. Some personal uses may require an ITIN, which is issued by the IRS.
Do you open bank accounts?+
We guide you on banks and fintechs, but account approval always depends on the institution.
Is Atlas a law or accounting firm?+
